VETERANS’ EQUALITY ACT SIGNED INTO LAW

(Source: Rick Noreault, CSEA Region 5 Legislative and Political Coordinator, June 1, 2016)

CSEA achieved a major legislative goal late last night when Governor Cuomo signed the Veterans’ Equality Act (S. 7160 – Larkin / A. 9531 – Paulin) into law.  This new law, which goes into effect immediately, allows all public employee military veterans who were honorably discharged, regardless of where or when they performed military duty, to buy back up to 3 years of military service time for pension credit.

Previously, only veterans who served in date and location specific military conflicts were eligible for the credit. This restriction led to thousands of military veterans to be excluded from utilizing this program, including those who served in Afghanistan. The new law recognizes that all military service matters and is valued by New York State.

In order to buy back the credit, a public employee must:

  • Be honorably discharged from the military;
  • Have 5 years of credited public service; and
  • Pay either 3% or 6% of salary, depending on pension tier, for each year of credit that they are purchasing.
